Who makes law? Readings for February 10, 2009 Course Focus: What is law? Proposition 215: The Compassionate Use Act of 1996 1. What is a ballot referendum or a ballot initiative? From the book: “A common vehicle through which citizens can more actively participate in lawmaking, a means by which voters can ‘take the law into their own hands’.” From the internet: A direct vote in which an entire electorate is asked to either accept or reject a particular proposal. 2. What does California Prop 215 propose to do? The purpose of the California Prop 215, in the simplest sense, is the to have voters of California vote on legalizing marijuana for medical regards. The main provisions (1) allow medically ill Californians the right to obtain and use marijuana for medical purposes where the medical use is deemed appropriate and has been recommended by a physician, (2) insures that the patients who obtain and use marijuana are not subject to criminal prosecution or sanction, (3) encourages the federal and state government
