MIDTERM 2 Midterm Questions The first question posed is “According to the Judicial Education Center, what are the five defenses to a breach of contact claim, provide examples of each”. There are a number of defenses to the breach of a contract, but some are more common than others. One example of this would be that a contact cannot be enforced if the contract contains any illegal acts. An example of this would be a contract for the buying or selling of illegal drugs. A contract also cannot be obtained by fraud. An example of this might be a contract to buy a painting that is claimed to be painted by Picasso but the seller knows that this is not true. A contract must also provide consideration. For example, if a man knowingly enters into a contract to pay someone $100 for work knowing that they do not have the money, the contact would be invalid. A contract also cannot limit the amount of damages that be recovered. An example of this would be if the contract stated that someone
