Liberty is about individual rights, freedom, etc. and is the protection from state intrusion of an individual. What is liberty? o Right to be free from unwanted government intrusion 14 th amendment was directed to end slavery Stare decisis: standing by and thus reconfirming previous court decision(s) on an issue. Landmark decision: when a court establishes a new precedent either by reinterpreting law(s) in a new way or creating a ruling in an area that previously had not been subject of a court case. Eisenstadt v. Baird o State law: contraceptives distributed to unmarried people is unconstitutional o Court argued this is discriminating o It is private whether you want children or not o Overturned Griswold v. Connecticut Roe v. Wade o State law prohibiting abortion violates privacy and infringes on liberty
