The Health Information Technology for Economic and Clinical Health (HITECH) Act was made part of the American Recovery and Reinvestment Act of 2009, it was to promote the adoption and meaningful use of health information technology and signed into law on February 17, 2009 (Sanderson, 2016). Since HITECH became a part of the American Recovery and Reinvestment Act several significant changes to the privacy rules contained in the Health Insurance Portability and Accountability Act of 1996 (HIPAA) was made (Woods, 2009). On August 24, 2009 the Department of Health and Human Services (HHS) issued the interim final rule for the new security breach notification. A breach is defined as the acquisition, access, use or disclosure of patient health information (PHI) in violation of the HIPAA Privacy Rule (Woods, 2009). Under the HITECH Act unsecured PHI essentially means unencrypted PHI. The Act requires that patients be notified of any unsecured breach. If a breach impacts 500 patients or more then HHS must also be notified. Notification will cause posting the breaching entity’s name on HHS website.
