Viewing Social Security's history - Chronologically i. 1934-48: The Foundation Years ii. 1934-35 - The threat and strategies iii. Serious constitutional questions iv. Unemployment compensation v. Some states already had this set up vi. Proposed federal payroll tax on employers with a credit for those paying to support state unemployment program. vii. Introduced in congress in Feb. 1934 but that didn’t move. viii. FDR sent to congress a message on economic security and established a committee on economic security. ix. This committee established that OAI couldn’t be established on this federal/state cooperation scheme. x. Proposed another scheme of withholding – an excise tax for employers and income tax for employees. xi. Many injunctions ensued. xii. Railroad retirement act of 1934 established a mini SS program for all subject to Commerce Clause. xiii. Majority decision: denial of due process to carriers xiv. Defective for operating beyond federal power. xv.
