Laura Brenneman October 5, 2016 POLSC 219 Case Brief #1 Price Waterhouse v. Hopkins ( 1989) Issue: In order to avoid liability, does the defendant have to prove, by preponderance of evidence, that an employment decision was made irrespective of the plaintiff’s gender? Procedural Posture/History: The District Court held that Price Waterhouse had unlawfully discriminated against Hopkins, but that Hopkins was not entitled to full damages because her lack of professional behavior and overt aggression contributed to Price Waterhouse’s decision to deny her promotion. Facts of Case: Ann Hopkins was a senior manager at Price Waterhouse and denied a promotion to partnership two years in a row. Of the 662 partners at Price Waterhouse, only 7 were women.
