Nathaniel Hilbert Basis of Law Questions Legal 250 Hilbink 1. I think the system we have is a good basis for law. I think that the checks and balances we have in place allow the concept of precedent stand up, while allowing chances for change in different forums. Obviously, I don’t think that we should do everything the way its been done in the past, but history is a place to look for examples and guides. I think the average American might offer a similar response. Although I think many Americans have the idea that morality and law should be one and the same, I also believe that they respect the idea of majority rule. 2. In “Why the Haves Come Out Ahead,” the basis of law is money and/or power. “Law and Popular Will” shows the basis of law as popular will. It says that customs lead to laws and that the line between morality and law is blurred. “The Compassionate Use Act of 1996” shows a struggle between popular will and precedent of the law or the higher authority of the federal government.
