CASES Dred Scott v. Sanford Congress had no right to pass Missouri Compromise because the court did not have jurisdiction because blacks were never citizens so they couldn’t bring their case to court; precipitated the Civil War. NAACP v. Button VA violated constitution because they failed to come up with a compelling reason; the people can use litigation to push for political change; violated freedom of speech; NAACP was being prosecuted for violating the 1 st amendment; ct struck down VA statute. NAACP v. Alabama 1 st time the court recognized freedom to associate; the court said that the members of the NAACP have standing in the case because their interest was identical; the court said that Alabama violated the constitution because they failed to come up with an adequate reason of why they needed the list because of public hostility previously suffered; court said that AL was violating the due process clause of the 14 th amendment. Strauder v. West VA Example of court facilitating civil rights; no black was allowed to serve on the petit or grand jury; court ruled that WV cannot have a law that excludes Af. Am. From petit or grand jury and according to the 14 th amendment, blacks and whites should be treated equally. Court said that the problem with this law is that it excludes a whole race of people. Plessey v. Ferguson Court said that Louisiana can have separate but equal train sections for blacks and whites if DC can have separate but equal schools; the court said that legislation is powerless to wipe away racial distinctions; court said that legislation cannot wipe away discrimination.
