Used fproducts not usually covered. Used cars are sometimes but not usually covered under product liability. What if sells product as part of service? Go to dr. get hip replacement. Bill is 2,000 for plastic hip and 8,000 is for the medcial. It’s a service contract, so not liabel eventhough encorporated in the deal is not product liability. Lets say go to expensive restaurant, pay 150 for dinner, something wrong with the meat. Is the 150 for the steak or the whole service. Clear it would be a sale. Go to beuty parlor, get hair style and part of the sale is the lotion, is it incidental product with service or product sale. Seems to be would be proper defendant. Produc tmust be defective when it leaves the defendant. 3 diff types of defects: 1) manufacturing defect – the product is not the way the manufacturer wanted it to be. Prob is with evidence – if accident and left with mageled parts. 2) design defect - made correctly
