Legal Environment of Business Case Brief Roberts v. Century Contractors, Inc. Court of Appeals of North Carolina, 2004 162 N.C.App. 688, 592 S.E.2d 215. FACTS In 1993, Bobby Roberts (the plaintiff), an employee of Century Contractors, Inc. (the defendant), was struck by a pipe in a work related incident causing neck and back injuries. Roberts obtained a medical diagnosis from Dr. James Markworth of Southeastern Orthopaedic Clinic. Dr. Markworth advised surgery and treatment, which Roberts did. Afterwards, Dr. Markworth concluded that Roberts was at maximum medical improvement. Roberts and Century agreed to a payment of $125,000 plus all medical expenses. Part of the agreement was that Roberts waived his right to make any more claims to his injury. Five years later, Roberts continued to experience pain from the injury suffered in 1993. Roberts acquired different diagnosis from Dr. Allen Friedman. Dr. Friedman concluded that Roberts was not and never was at maximum medical
