Free Response Essay: Articles of the Confederation vs The Constitution The United States has operated under two constitutions. The first, The Articles of Confederation, was in effect from March 1, 1781, when Maryland ratified it. The second, The Constitution, replaced the Articles when it was ratified by New Hampshire on June 21, 1788.The Articles of the Confederation and the Constitution have a lot in common and also many differences. In one document the Congress had the power to do something that they did not have the power to do in the other document. The most important similarity was that the country set up by each document was to be a democratic country. There is no provision for a monarch in either document. In both documents, it is forbidden to create and grant “titles of nobility.” There was to be no monarchy or aristocracy. There were some other relatively important commonalities. Each document asserted that the national government should be in charge of foreign affairs.
