Although Stephanie was truthful and openly admitted to prescribing Mrs. Smith the medication an ethical concern would be the lack of integrity shown by basically forging my name for the prescription. Thisis just one incident that is known about, are there other prescriptions prescribed without my knowledge. There is also a great concern because there could be a mistake made while prescribing medication to the patient, which can result in harming the patient. A legal concernis that this is considered prescription forgery. Although prescription forgery is a crime, the prescriber's responsibility for reporting to law enforcement is not clear under current state and federal law. Federal laws and regulations, including the Health Insurance Portability and Accountability Act (HIPAA), do not permit prescribers in all circumstances to disclose prescription fraud to law enforcement (Singh, Fishman, Rich, & Orlowski, 2013). Whether legal action needs to be taken or not is uncertain, there would need to be some further investigation but Stephanie should be disciplined appropriatelyto ensure this doesn’t happen again.
