Brian Short v. State of Florida 1. The main issue – The main issue, in this case, is, that the law created by Florida that states that two people who are very short cannot get married unconstitutional. Does this law violate any of Brian and Jennifer Amendment rights? 2. Relevant legal concepts - 14 Amendment- Section 1. “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; not shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of laws” (pp.562). This amendment gives every individual the right to be treated equally, free of discrimination. 3. Relevant case law - Loving v. Virginia in 1967. In this case Richard Loving a white male who had a black wife Mildred challenged Virginia’s ruling that it was illegal for whites to marry blacks. This case was also a case of discrimination (pp. 25).
