Procedural History *An indictment was set to the Superior Court charging Richard John Gordon of armed robbery in which he was found guilty. He later entered an appeal. *A separate indictment was also sent accusing Gordon of having, with the intent to kill, and assault of police officer Harold Shultz. This indictment for assault was declared as a mistrial because the jury was unable to reach a verdict on the charge. * As ordered by the justice, which was requested by the state a single trial took place for both indictments, against the defendant’s objection. This trial proceeded before a jury. 3. Facts * The Defendant Richard John Gordon and one Edwin Strode escaped from Vermont authorities after being held on misdemeanor charges. * After eluding authorities Gordon and Strode acquired a blue station wagon and two
