Health Insurance Portability and Accountability Act of 1996 (HIPAA) is a Federal law
that safeguards sensitive Private Health Information from being disclosed without the patient’s
consent or knowledge. A major goal of this law is to properly protect an individuals’ health
information while allowing the flow of health information needed to provide high quality health
care, health, and well-being (CDC, 2018). The HIPAA Enforcement Rule states Security,
Enforcement, and Breach Notification Rules Under the Health Information Technology for
Economic and Clinical Health Act (HITECH) final rule is anticipated to have an annual effect on
the economy of one hundred million or more making it an economically significant rule (HHS,
2022). The HITECH Act revised the Social Security Act section 1176(a) increasing the minimum
penalty amounts for each penalty amount tier. The HITECH Act also adds a subsection (c) of the
Social Security Act section 1176 to include willful neglect as a possible violation. The penalty
