PA201 UNIT 3 ASSIGNEMENT - CONDUCT SOME RESEARCH 2 Jaworski v. Great Scott Supermarkets, Inc. , 403 Mich. 689, (1977). Facts – The Plaintiff has brought action to recover damages for the injuries that she sustained when she slipped and fell in the Great Scott Supermarket, Inc. Issue - Did Ms. Jaworski use the appropriate duty of care for herself while in the grocery store? Rule - The Supreme Court of Michigan reversed and remanded the ruling from the Court of Appeals of no cause of action to the Defendant because of error made in instructing the jury on issue of contributory negligence. Justice Fitzgerald set precedent from Goodman v. Theatre Parking, Inc. , 286 Mich. 80, 53 (1938). “Ordinary prudence demands that a view be taken of the place where one is about to step. Plaintiff failed to take such a view and, even if defendant was negligent in permitting a cinder to remain upon the lot, plaintiff’s contributory negligence bars recovery (Goodman v. Theatre Parking, Inc. , 1938).
