Concept of Judicial Review
The 1803 Marbury versus Madison case rendered Chief Justice John Marshall of U.S
Supreme Court to establish the principle of judicial review. The concept entails the power a
country’s courts to scrutinize the actions of executive, legislative and administrative arms of
the government, whether the actions are uniform with the constitution. It plays a crucial role
in ensuring that the different arms of government recognize their limit of power. Also, it
protects the civil rights and liberties of people. Chief Justice John Marshall noted it is
emphatically the duty of the Judicial Department to say what the law is. Those who apply the
rule to particular cases must, of necessity, expound and interpret the rule. If two laws conflict
with each other, the Court must decide on the operation of each (Blokhina, 2019).
