DIALOGUE 3 2 Question 1 What two elements of the CIA triad are referenced in this law, and in what section number(s)? The two elements of CIA triad referenced in this law are confidentiality and integrity. Confidentiality is referenced in section number 1 , which states: “The breach of secured personal information must be disclosed if the information acquired and accessed is not secured during a security breach or if the confidential process, encryption key, or other means to decipher the secured information was acquired by an unauthorized person.” Both confidentiality and integrity are referenced in section number 4 , which states: “For purposes of this section, "breach of the security of the system" means unauthorized acquisition of data that compromises the security, confidentiality, or integrity of personal information maintained by the person or business.” Question 2 When a disclosure notification is required, in what three methods may notification be provided, and in what section number, do you find the answer? The three methods that may be used to provide notice are written notice, electronic notice and substitute notice (email notice, conspicuous posting on the website of the person or business, notification to major or statewide media). The electronic notice should be used if "the notice provided is consistent with the provisions regarding electronic records and signatures outlined in 15 U.S.C. Sec. 7001”.
