Civil Rights Act of 1964 – Title VII A.) Prohibits discrimination on the basis of race, color, religion, national origin or gender. a. Prima facia case. = you just have to prove that discrimination was present. After this is done, burden of proof is put on the employer to show why the hire would be a bad business idea. Burden of proof is then put on to the first guy to show how that it would be a good strategy. B.) Applies to Employers with at least 15 workers, labor unions with at least 15 members and employment agencies that obtain workers for an employer, covered by the law.
