What is Probation ? Sentence to serve time in the community conditonal ” = often can be revoked (taken away) if don’t comply with conditions revocation = decision to remove person from probation If revoked, can be sent to incarceration facility Suspended Sentence = a prison term that is delayed under condition of community treatment. If fail, sentence is invoked. Often coupled with “ intermediate sanctions” Can be “ sentence ” attached to prison time (called a “ split sentence”) serve blank years in prison, then blank on probation Used more lately

First Main Function of Probation Departments is Investigation Investigation Probation staff prepare Presentence Investigation (PSI) Document used by judge to sentence offender, usually ordered after conviction Probation officer usually: Interviews offender to get background info (and sometimes other family) Then follows up to verify/clarify/explore info PSI document summary of what is learned & evaluation of offender with recommendation for sentencing Clear & Dammer, 2000

Purposes of Presentence Investigation (PSI) For long time, PSI was THE guideline for sentencing (before guidelines) now judges’ discretion constrained now less important part of sentencing mostly aggravating & mitigating circumstances Aggravating = make crime worse e.g., chopping body up Mitigating = make it less serious e.g., young age of offender, hurt abuser Other purposes evaluate appropriateness of plea agreement probation terms help classification decisions in probation, prisons & parole aid treatment planning aid parole decisions Clear & Dammer, 2000

Second Main Function of Probation Departments is Supervision of Offenders Begins once offender sentenced to probation Practices vary widely among agencies In general, 3 steps to whole process: Relationship is established & roles are defined (+terms) Supervision to help offender comply with conditions On basis of response to supervision, decision made about termination Adjustment satisfactory Sentence expired Revocation because new conviction or violation of probation Clear and Dammer, 2000
