PHM 2204 Fall, 2007 David Copp Lecture 23 DEMOCRACY, THE RULE OF LAW AND THE USE OF “PHYSICAL METHODS” IN INTERROGATION: THE SUPREME COURT OF ISRAEL. 1. Security Issues in Israel and the GSS’s Methods of Interrogation (T, 165-168) * Israel has been subject to terrorist attacks for many years * General Security Service (GSS) uses “physical means” of interrogation: (i) shaking: “forceful shaking of the suspect’s upper torso,” which can cause brain damage, harm to the spinal cord, etc. (ii) waiting in the “Shabach” position: suspect sits in a small low chair, tilted forward; hands tied behind the suspect, one in front of and the other behind the chair back; head covered; powerfully loud music is played. (iii) the frog couch: crouching on tips of toes for 5 minute intervals (iv) excessive tightening of handcuffs, (v) sleep deprivation 2. Arguments of the “Applicants” (to show GSS interrogation methods are prohibited): (1) GSS is not authorized to interrogate – violations of rule of law (168) (2) GSS physical means of interrogation are criminal offenses (169). (a) infringe the human dignity of suspects and so are “cruel and inhuman” or “degrading” treatments prohibited under international law.
