I. Hospers a. Rule Utilitarianism is needed to correct for the problems with Act Utilitarianism that his examples show. i. Problem with Act Util Lots of cases (Babe Ruth) when Act Util contradicts moral intuitions 1. Mill saw weaknesses “Moral Infirmities” b. Rule Utilitarianism – Emphasizes it is the consequences of instituting a practice that have to be looked at and evaluated. c. Problems with Rule Utilitarianism: i. Two Forms of Justice` 1. Pure Procedural Justice (PPJ) a. X is Just when and only when it is the result of following accepted rules. [Criminal Justice Systems] 2. Distributive Justice (DJ) a. (Strong Version) X is Just when and only when X distributes goods only to those who deserve them. b. (Weak Version) X is just when and only when X distributes goods as equally as possible. i. What’s more important than following the rules is the idea that only the guilty get convicted. ii. ii. Often Pure Procedural Justice does not yield Distributive Justice iii. Rule Utilitarianism is basically Pure Procedural Justice iv. Act Utilitarianism is basically Distributive Justice v. Criticism 1 When Pure-Procedural Justice conflicts too much with Distributive Justice, We fix Pure Procedural Justice. 1. This means that the basic form of Utilitarianism is Act Utilitarianism. 2. Rule Utilitarianism degenerates into Act Utilitarianism, so why use RU at all? vi. Criticism 2 What is a rule?
