Contract lesson week 9 notes Exception clause: - Limitation of liability (usually for damages) clauses: in terms of damages if the contract was breached - Exclusion of liability clause: should I breach the contract then I owe no liability to the other party in the contract, cannot be sued for damages but can sue the guy and force the guy to perform the duty that he was supposed to do by order of court - Exclusion of duty clause: more extreme clause to protect oneself in the case of breach of contract?? - Benefits if appropriately using exception clause to Limiting liability= extend to which I can be sued is capped and thus I could be more cost savings and pass on the savings to customers ect. - Receipt with an exception clause cannot be considered as a provision under the contract, receipt is too late to include the clause as it is not part of the factual
