Criminal Law Week 3 Lesson 2 1. Rules – to maintain law and order, stability/peace 2. Purpose of Criminal Laws – punishment (principles-proportionality), type and quantum (based on public interest) 3. Enforcement – missionary to do this enforcement to make law effective (corruption??), some offences hard to enforce (ban on chewing gum) (Nowadays, move towards decriminalization to loosen virus) 4. Mechanism for enforcement, components of criminal justice system – police, prosecutor, judge, correction services. What is justice? Should seek to balance the interests of t mhe individual with the welfare of the general community 1. system of justice – equal representation, fairness, punishment/guilty, impartiality, right to be heard (natural justice), proof of wrong doing (beyond reasonable doubt-> ensure only guilty, certainty) 2. Due process - presumption of innocence until proven guilty beyond reasonable doubt 3. Trial – truth is what the evidence says, he who alleges must prove beyond reasonable doubt 4.
