Kelsey Jans FRL 201 2/19/08 Case Brief 10.3 p.220: Chapter 10 Citizens Communication Co. V. Trustmark Insurance In the case, Citizens Communication Co. V. Trustmark Insurance, the court has to decide whether the agreement between Citizens and Trustmark constitutes a valid amendment under the terms of the insurance policy. Citizens Communication Co. had purchased Stop- loss insurance for their employees. The insurance reimburses the corporations for claims paid under its self- funded plan. Citizen provides this health insurance under the self funded health plan. Trustmark Insurance had a medical- stop loss insurance policy for Citizen employees. This policy ensured an individual deductible of $100,000. An employee at Citizens Communication Co. ( Gary Lonquist) underwent a heart surgery and Citizen Communication Co. had faxed Trustmark a notice that Lonquists stop-cross claim was $1,053,657 and that the bills reached up to $3.1 million. Trustmark decided to give Citizen Communication two options. Citizens could accept the recisson-
