1. Your supervising attorney has asked you to send discovery requests that you have drafted although he has not reviewed them. Rule/Canon : Rule 5.3 Responsibilities Regarding Nonlawyer Assistance/ Canon 2 - A paralegal may perform any task which is properly delegated and supervised by an attorney, as long as the attorney is ultimately responsible to the client, maintains a direct relationship with the client, and assumes professional responsibility for the work product./EC-3.1 A paralegal shall refrain from engaging in any conduct that offends the dignity and decorum of proceedings before a court or other adjudicatory body and shall be respectful of all rules and procedures/Guideline 3, Guideline 5 Violation/Correction: A paralegal is under supervision of the lawyer and must be reviewed and signed by the lawyer. Completing and sending the requests without the lawyer reviewing them is a violation. I would correct the situation by reminding the lawyer he has not yet reviewed them and that still needs to be completed before they can be sent. I would coordinate doing so and them send them. 2. Two other employees are gossiping about a client loudly enough for clients in the waiting area to hear. Rule/Canon: Rule 1.6 Confidentiality Of Information/ Canon 7 - A paralegal must protect the confidences of a client and must not violate any rule or statute now in effect or hereafter enacted controlling the doctrine of privileged communications between a client and an attorney./ EC-5.1 A paralegal shall be aware of and abide by all legal authority governing confidential information./ Guideline 1 Violation/Correction: Discussing a client without consent in means which other parties can obtain information in a violation on confidentiality. I would correct the situation by informing the employees, asking that they stop speaking about the client and remind them of them rules of confidentiality and report it to the lawyer to prevent possible/further harm. 3. You have become aware that another paralegal in your firm is padding her billable hours to qualify for a bonus. Rule/Canon: EC-2.3 A paralegal shall ensure that all timekeeping and billing records prepared by the paralegal are thorough, accurate, and honest. Violation/Correction: Altering billable hours, which are not accurate and honest is a violation, and I would report it to the supervising lawyer. 4. You have discovered that your supervising attorney is not returning telephone calls to clients. Rule/Canon: Rule 1.4 Communication, Rule 1.3 Diligence A lawyer shall act with reasonable diligence and promptness in representing a client. Violation/Correction: Not maintaining communcation through lack of diligence, promptness, and response to resonable client requests is a violation. I would correct the situation by reminding the lawyer of the client's who called and they need to be returned, ask if I can assist him in any way, and inform him I am available to return the calls if needed.
