Lesson 1 Focus: What are the qualifications to become a state judge at each of the levels within the judiciary? What are the different methods of judicial selection used throughout the United States? Which does Nevada use? What are the terms of office for the various judges in Nevada? Identify and describe the four methods of judicial removal. Judicial Qualifications, Selection and Removal Judiciary - exists to interpret state laws and the state constitution. Separate and independent of US judiciary. US Federal Judiciary interprets national laws and the US constitution. There are 5 types of courts that exist in NV Supreme court Qualifications: Chosen in nonpartisan elections - voters decide who will become the justices. On the ballot there are no party affiliates listed (not saying these candidates aren’t active with a political party, indeed most of them are.) Serve 6 year terms 25 years old Qualified elector (non-felon) Attorney licensed in Nevada 2 year resident of the state As of 2005 they need 15 years legal experience. (so we have more qualified justices / judges serving. ) Other States use gubernatorial appointment, legislative appointment and partisan elections (party is listed on ballot) and the merit plan (Missouri plan - first state to try it.) - Merritt plan is a mixture of both appointment and election. Drawbacks to nonpartisan election, even in nevada the Merritt plan is prefered by many. Court of appeals Qualifications 25 years old Qualified elector (non-felon) Attorney licensed in Nevada 2 year resident of the state As of 2005 they need 15 years legal experience. (so we have more qualified justices / judges serving. ) 6 years Chosen in nonpartisan elections (SAME AS SUPREME COURT) District court Qualifications: Non-partisan elections
6 year terms Must be 25 years old Qualified elector Attorney licensed in nevada 2 year resident of the state Must have 10 years legal experience The same as those of the supreme court and court of appeals EXCEPT with regard to legal experience. Justice court Qualifications Nonpartisan elections 6 year terms Qualified electors 30 day resident of the state High school diploma In counties of 700,000 people or more, with towns of 100,000 people or more the candidates must be attorneys for 5 years. In counties of less than 700,000 but where the town has more than 250,000 people they must also be attorneys for 5 years. Legislature wanted to ensure that you have qualified justices serving in large populations. Legal complexities may increase if you have a larger population Municipal court Qualifications Vary in election method Some are chosen in nonpartisan elections and serve 4 year terms IE: las vegas Some are chosen by city council IE: boulder city Citizen of the state Resident of the city for 1 year Qualified elector Cities may also incorporate additional requirements if they wish Judges are NOT subject to term limits in Nevada.
