Notes: P386 The definition of consumer is provided by ACL s3 : 3(1) A person is taken to have acquired particular goods as a consumer if, and only if: (a) the amount paid or payable for the goods, as worked out under subsections (4) to (9), did not exceed : (i) $40,000 or (ii) if a greater amount is prescribed( 规定 ) for the purposes of this paragraph--that greater amount; or (b) the goods were of a kind ordinarily acquired for personal, domestic or household use or consumption; or (c) the goods consisted of a vehicle or trailer acquired for use principally in the transport of goods on public roads. (2) However, subsection (1) does not apply if the person acquired the goods, or held himself or herself out as acquiring the goods: 题目 : a. Sue, who is a farmer, buys a tractor for use on her farm from Tractors Galore Ltd for $39,000. Less than $40,000 and for personal use=Consumer. 注意 : if you buy a tractor for over $40,000, that must be used for commercial purposes Consume. e. Betty and Tom buy a second-hand bus for $52,000 to use as a campervan in a round-Australia holiday trip. Over $40,000. And ordinarily people would not buy a bus only for personal use Consumer. f. A contract for the purchase of 5 tonnes of sugar, to be used to make chocolate, for $309,000. Over $40,000. And the sugar must be used for the process of chocolate manufacture Consumer. g. A brand new diamond studded limited edition 50-year commemorative Panerai watch for $100,000. Over $40,000. But for personal use=Consumer.
