FRE 403] Facts/Procedural Posture: McRae convicted of killing his wife. Shooting her through the head. McRae claims it was an accident. Wants to get rid of gruesome pictures presented by prosecution o Claimed that pictures should have been excluded via rule 403 relevant evidence that substantially outweighed by the danger of unfair prejudice. Issue: Should the evidence been excluded under rule 403 based on concerns of unfair prejudice?
