Code: Valid cases,  Overturned/Not valid Cases,  Constitutional Clause, Explanation,  Statute, Theory, General Rules,  Tests —PART 1: THE CONSTITUTION AS A DOCUMENT OF STRUCTURE AND POWERS— THE SUPREME COURT’S AUTHORITY 1) Marbury v. Madison a) Chronology i) ii) 2/4/1801 –Marshall takes office as Chief Justice after being appointed by Adams.  Marshall continues to serve as  Secretary of State iii) reduces Supreme Ct. from 6 to 6 justices. iv) 2/27/1801 – Federalist Congress passes Act creating 42 new justices of Peace in D.C. v) 3/3/1801 – Senate completes confirmation of new J.P.s, but Marshall fails to deliver all new Justices’ commissions. vi) vii) viii) 2/1803 – court hands down its decision in Marbury.  6 days later, it upholds repeal of Circuit Courts Act against  constitutional challenge. b) US Constitution, Art III, §2 i) treaties made, or which shall be made, under their authority; … to Controversies between 2 or more states; … between a State & Citizens of another states;…between citizens of different states;…between citizens of the same  citizens OR subjects. (1) be a party, Supreme Court shall have original jurisdiction.  In all other cases before mentioned, Supreme Court  Congress shall make. c) Sec.13 of Judiciary Act of 1789, 1 Stat. 73 . d) Marbury v Madison i) 3 questions (1) Does Marbury have right to commission he demands?
