Forum non conveniens —when the chosen forum would oppress the defendant or is administratively  inappropriate Relevant Cases Piper Aircraft Co. v. Reyno 1) Case regarding an airplane crash in Scotland where a lawyer’s secretary filed a wrongful death action for  American citizens in California state court.  a) The case was removed to a District Court in Pennsylvania (diversity applied) b) The petitioners (defendants) won dismissal via  forum non conveniens  saying there was an alternate forum in  Scotland, but the respondents won an appeal on the basis that the plaintiff shouldn’t have to try in a less  favorable forum c) The court was probably wrong in its decision, as California state law would have partially applied and was  undoubtedly more generous than the federal law on  forum non conveniens. d) The court held that unfavorable forum shouldn’t bar dismissal and based on the facts, upheld the  forum non  conveniens dismissal. 2)
