Name of Course Islamic Legal System Course Code MAI 5013 Islamic Legal System Synopsis This course surveys historical development of the Islamic legal system, from the period of the Prophet Muhammad ( saw ), the period of Khulafa’ al-Rashidun , the Umayyah period and the period of the ‘ Abbasiyyah . The study would also introduce the development of the four Sunni Muslim schools of law ( madhahib al-‘arba’ah ). The survey also touches the fundamentals of both the civil legal system and the Islamic legal system legal system: the position and structure of the Shari’ah courts and the civil courts system and illustrates how Islamic financial transactions apply within the jurisdiction of this dual legal system in the contexts of Malaysian business and finance practice. Objectives The goals of this subject is to: Acquaint students with the nature of the Islamic legal system in Islam. Provide students with the knowledge of the nature of the civil law system and the Islamic legal system as well, and their practical application on legal issues of Shari’ah compliance. Provide students with general understanding about the concepts and structure of some important contracts in Islam and how they are applied in the light of their modern application in business and finance industry.
