Mere mechanics – prestige was low Law -selections from Tang legal code -Lawyers were not that important on social scale -If you have a law case – determined by magistrate -If you have a civil complaint – should be worked among selves -Confucian and legalist both in the Tang legal code -Confucius – shouldn’t need laws – society would be well ordered without laws if people followed the five relations -Ruler to minister -Father to son -friend to friend, etc. -legalist – closely written laws – all types of crime – specified in the legal code, fully publicized – should be aware of this – no exceptions -first emperor – many harsh laws – -Under Han – put together -Legalist part – many harsh penalties for major crimes -Easy to apply in magistrate – determine the facts
