Running head: AVOIDING UNAUTHORIZED PRACTICE OF LAW 2 A frequent concern for many practicing attorney’s is the use of paralegals because when a paralegal’s actions may lead them with having to perform tasks, such as advising on legal rights, negotiation or settlement, management of a law practices which could result in the paralegal being in use of the unauthorized practice of law. The American Bar Association, clearly states that one must possess a law license to perform any of the above-mentioned tasks. In this paper, I will attempt to give a clear understanding of how a paralegal can avoid unauthorized practice of law. Most laws and regulations are important because they help to keep order and organization. per USA.Gov, congress can create and pass bills. The president of the Unites States must then sign those bills into law. The federal courts may use these laws and enforce them if they do not agree with U.S. Constitution (USA.gov). Laws are involved in every mode our life. There are laws for living in a society, laws for operating business, laws for saling products and for the consumer. Laws make up the very foundation of our economy they are set in place for a reason not to jut control us as people. It is necessary for us as people in the legal environment to be aware of these laws and regulations. It is the legal team’s responsibility to know the in’s & out of the courtroom procedures. Paralegal must to know the proper protocol for filling legal forms. They must obtain proper training, knowledge, both oral and written skills to assist an attorney. Running head: AVOIDING UNAUTHORIZED PRACTICE OF LAW 3 Let me start by listing three must have characteristics of a good paralegal. Paralegals play a huge role in most lawful cases. They are the right hand to their lawyers by prioritizing and accessing records and cases. They also assist with building files, preparing most legal documents. They need to at least have an associate’s degree, bachelor’s degree, or a paralegal studies certificate. Another thing they need is proper training or work experience. Many paralegals come from previous work within the field of medicine, so they may use their prior medical experience in a law firm that handles a lot of medical malpractice cases. Paralegals need to be very resourceful, they need hold the ability to handle different situations and find solutions to a lot of different issues, problems and situations. They need to have great communication skills, be confident, authoritative, all while still being understanding to clients’ needs and concerns.
