Chapter 15 – IRAC Cases 15.1, 15.2 & 15.3 Case 15.1 L&H Construction Co. v. Circle Redmont, Inc. Issue: Did both parties really agree that Circle would do the complete installation or just the supervision of installation? Rule: Mutual mistake of fact by a scrivener’s error Analysis: L&H contracted with Circle to make a cast-iron staircase and flooring system. Originally Circle was to engineer, fabricate, and install it but during negotiations both parties decided that Circle would not install but provide “supervision of installation” instead of “complete installation”. However on the final contract, both sets of statements were included on the contract. Conclusion: The appellate court reversed the lower court’s judgement in favor or Redmont. 1 | P a g e
