Chapter 34 – IRAC Cases 34.1, 34.2 & 34.3 Case 34.1 Waddell v. Boyce Thompson Institute for Plant Research, Inc. Issue: Was there a proper claim for breach of contract? Rule: Absent an agreement establishing a fixed duration, an employment relationship is presumed to be a hiring at will, terminable at any time by either party. Analysis: Waddell worked for Boyce without an employment contract. Waddell complained to his supervisor repeatedly about filing certain financial documents more promptly. A few months later Waddell was fired for insubordinate conduct which violated the Institutes Code of Conduct. Conclusion: The appellate court found in favor of the Boyce. 1 | P a g e
