Case Study Week 5 Due to James Duke (the head of the police department’s Administrative Bureau) informing Sgt. Quon that his activities of the pager would not be monitored as long as he paid for any overage of his use, a reasonable amount of privacy was expected. The courts decided that Jeff Quon (a police sergeant) and other officers did have a reasonable expectation of privacy. The search was to see if there was a need for higher character limits for the officers and not bring Sgt. Quon’s personal text messages to light. James Duke was tired of collecting fees for the overage and requested the transcripts of the officers. When he did this, he did not stick to his word of not monitoring the texts as long as they paid for the additional fees. The courts decided there were other ways to obtain the information the Ontario Police Department was looking for without reviewing the text messages. However, the final decision of the court deemed that the city’s review of the texts was a reasonable work related search. Judge
