What is Real Estate? Real Property- property such as land and everything attached Personal Property- property that is movable Deed- document used to transfer real property rights and ownership Title- your ownership and your rights to that real property (not a document unless its personal property) Title is information not proof; it is found on the deed Bundle of Rights- If you own property you have the right to Sell Occupy Use Enjoy Encumber- something that burdens or limits your title(ownership) Lease Exchange Share 3 ways to transfer property Sell (grant) Will Steal (adverse possession) Others that may have rights in real property Taxation (gov’t) Morttgage (lending institution) Easement (irrovacable) Land Spot on the earth, everything below the surface of the land, and everything above Physical Characteristic- Immovable, Indestructible, non-homogenous (unique) Economic Characteristics- Situs(location), Scarcity, Improvable, permanence of
