Chapter 1 - Background Nature of Law: 1. Natural (there’s right and wrong) 2. Positive (importance on the process) Positive law used to say it was okay to own a person, but natural law said it was  wrong to do so. Significant legitimate use:  does not infringe copyright laws (VCR) Sources of Law 1. Constitution 2. Statutory (legislative branch) 3. Common (judge made law) *weakest Stare decisis:  Judge’s normally uphold the law but hold the right, if not statutory law, may create  a law based upon their decision. Legal System 1. Supreme Court 2. Court of Appeals 3. Trial Court Trial vs. Appeal:  appeal is a review of what has been decided.  In trial court, we find facts and  apply the law. Chapter 5 – Business Ethics *NO DIFFERENT FROM PERSONAL ETHICS When are you facing an ethical question?:  If your decision effects someone else. Ethical reasoning:  Identify the facts and apply an ethical standard. Ethical standards

Individuals should evaluate their actions in light of the consequences that would follow if  everyone  in society acted the same way. Example: if you adopt Kant’s categorical imperative, you will not cheat on an exam  because if everyone cheated, the exam would be meaningless. Tort Law:
