US companies should be liable and not exempt from tort liability. If they fall short of a standard of care that causes injury to others, then they are liable for the tort of negligence (Seaquist, 2012). There are four elements that establish this tort. The company has a duty of a reasonable standard of care (Seaquist, 2012). Especially in the food industry, the products are going into our bodies and could easily cause illness or death. Food companies have a responsibility to provide a safe food product. Secondly, the duty of care must be breached (Seaquist, 2012). The retailers are knowingly purchasing products from China that are not regulated under the same standards as the US. China doesn’t have a regulatory regime that includes inspections, monitoring and enforcement of food quality (CSPITV, 2008). Additionally, certain food products manufactured in the US are using ingredients from China without the consumer knowing. Apple juice, which is made from apples imported from China, will not list that the apples are sourced from China on their labels (CSPITV, 2008). Withholding information and not
