LAW AND GOVERNMENT ORIGINAL CASE STUDY 2 Law and Government Original Case Study Summarize the seminal facts of the case that you chose. The case we are going to look at in this assignment is the Mapp v. Ohio case. This is a very famous and landmark case which was ruled in 1961. On 23 rd May, 1957, three officers went to Miss Mapp's house since they had received information from an anonymous caller that a wanted bomb suspect might have been hiding in the house and that there was a lot of paraphernalia which had been hidden in the house. When they got to the house the police knocked and they demanded to be allowed to enter and search the house as request which Miss Mapp refused after she consulted her lawyer since the officers did not have a warrant legally allowing them to search the house. Sometime later, the police officers came back this time with more of them and forceful opened several doors after they knocked and she failed to show up at the door immediately and gained entrance into her house. Miss Mapp was halfway down the stairs going to open the door when this happened. By this time, Miss Mapp’s attorney had already arrived and he was denied permission to enter the home or to talk to his client. Miss Mapp demanded to see a warrant for search and one of the officers flashed out a paper which he claimed to be the warrant. Miss Mapp grabbed it and put it on her blossom as the police struggled to get it back. The police handcuffed Miss Mapp following the struggle after they had recovered the paper in the process which they twisted and hurt her hand. As the police officers searched all the rooms in the house, they discovered pornography in Mapp's house which was illegal and they went ahead to arrest and convict

LAW AND GOVERNMENT ORIGINAL CASE STUDY 3 Miss Mapp on the basis of possession of obscene material. When the case was taken to trial, the prosecution did not produce any search warrant and they also did not explain why they failed to produce any search warrant (Persico, 1997).
