2 RUNING HEAD; Finance and business environment Respondeat superior When respondeat superior is applied, an employer is held accountable for an employee’s negligent or offences that occur during the employee’s employment period. This indicates that the employer will be liable under respondeat superior if and only if during the occurrence of the incident, the employee was working under the direct orders of the employer . This doctrine obligates vicarious liability, or indirect liability, on the employer. This means that the liability does not take regard of the personal responsibility of the employer for the faults and torts committed by the employee during their period of employment. For instance, if a delivery driver’s negligence results in a car accident, if an individual is injured they may be able to sue the delivery driver’s employer, which is mostly a processing company, for the injuries sustained. This will make a big difference, if the victim of the accident eventually recovers from all his or her injuries after a judgment. A plaintiff will need to prove employment relationship and to his/her negligence this will seal the judgement. Respondeant superior should be modified. This will ensure every employee acceptance of their responsibilities and account for their mistakes alone. Employees should not be held responsible for an employee’s actions.
