Yes, the federal government should have the right to ban marijuana under the Commerce Clause of the U.S Constitution. Many states have legalized the use of marijuana whether it is for medical or recreational use. It is a strong possibility that the marijuana could cross state lines causing problems to the neighboring states. In so many words, if that product crosses state lines it becomes a commerce problem which in fact the federal government has to intervene. Take for example the state of Colorado; marijuana is legal to smoke and carry around up a certain amount. If the marijuana crossed over into Utah or Kansas, it falls within federal jurisdiction. Although marijuana is legal in some states, the federal government has to control the production and illegal use of the drug. The Founding Fathers charged the federal government with supervising internal, interstate commerce, due to harmful tariff wars that had developed between the states immediately after the War of Independence.
