LANDLORD-TENANT LAW 2 Abstract The paper will examine the tenant and landlord legal rights and responsibilities. Then, it will explain if the landlord or tenant had a legal duty to mitigate damages in the case. Next, the paper will observe whether the landlord has the legal right to evict Roger. Finally, the paper will explore whether the tenant has a legal obligation to pay for the damage he caused and determine if the landlord would be liable for any damage.

LANDLORD-TENANT LAW 3 Landlord-Tenant Law Landlord and Tenant Responsibilities The landlord and tenant have specific duties according to the lease and the law. Larry Landlord and Roger Renter both signed a valid contract or lease. The actions of Larry and Roger lead to a closer look at landlord-tenant law. Larry Landlord would like to evict Roger because of the damage he caused by throwing a baseball bat at the wall out of anger. Roger is upset because there is a leak in his apartment that has not been addressed. The leak caused damage to the apartment and the property of Roger. Both issues are addressed in basic knowledge of landlord and tenant legal responsibilities. Larry Landlord is a landlord with the responsibility to the tenant whom he is leasing the premises. The landlord has the responsibility to rent a property to a tenant and deliver possession of a habitable space for living. (Beatty, Samuelson, & Abril, 2016.). The premises should follow building code and remain habitable for the entirety of the lease. (2016.). The actions may include maintaining areas, so they are livable, making repairs to keep the property up to building code, and make sure the tenant has quite enjoyment of the property. (2016.). The landlord must maintain communication with the renter to mitigate any damage. (2016.). Larry Landlord provided the premises to Roger through a valid contract. The two had an agreement of the rights of landlord and tenant. The premises was habitable upon rental and Roger reaffirmed with Larry in his concern about possible leaks. Larry affirmed there were not any leaks on the premises. The building was up to code and Roger was a model tenant. Roger Renter has a responsibility to use the property in a manner within the contract and not cause damage to the property. Roger is responsible for making rent payments, use premises
