POSC – Lecture 4 He pushed the midterm back, what day? I forgot… Marbury   created doctrine of Judicial Review, courts can strike down acts of  congress.  Raises a whole host of issues: o 1) how does that affect the role of the judiciary? o 2) if you give judiciary the power of judicial review then you will be  throwing off the balance of power.  Ekan v rob?? case   who really should have the ability to make these final  determinations? The constitution (embodies popular sovereignty), if the courts are there  to protect the constitution, then aren’t they really the ones to be connected to the  people? Gibson doesn’t really buy all that.  It is a dissent, a judge venting his opinion.  Who should really be making these policy decisions? Judicial review is all about  policy decisions through striking down acts of Congress and making rulings.
