ISSUE RULE  ANALYSIS CONCLUSION ISSUE – there are 2. [FIRST IDENTIFY HOW MANY ISSUES THERE ARE]  (probably going to be 2 issues on the midterm) 1) Standing o Does FOF have standing to sue Hafner industries.  o 3 factors that came out of Lujan to consider whether a party has  standing.  o – legally protected interest no legally protected right, no personal injury? Sue and Sam have never used the lake for recreation!!! They are trying to sue on behalf of people that do go to the lake.  Although the plaintiffs did not use the lake, they were still living  in the area that was part of the community, there may be some  other negative impact.  Sam and Sue therefore may have a sufficient injury.  o – palpable connection between injury and conduct
