POSC – Lecture 12 Responsible up to the Boudemin case.  Not going to include appointment power.  2-3 short answers Specific information Requires reasoned opinion! Must give an opinion, respond to each of the  requirements.  2 hypo’s.  Court seems to forever address the same issue over and over again, its because the law  changes.  Hamden   main issue was the validity of the commissions, whether or not the president  had the authority to conduct these commissions when congress said nothing about them.  Court had to look for some sort of model for military commission. Court looked through  laws of war and examined how commission was run in Hamden’s case against the  requirements of international war.  Court concluded that there were a number of problems with Hamden’s  commission.  court struck down Hamden’s conviction for conspiracy based upon the tribunal.
