The primary difference between Civil Law and Criminal Law is that in Civil Law the burden of proof is preponderance of evidence, and in Criminal Law the burden of proof is beyond a reasonable doubt. For example, civil law is decided on a 49/51 scale, whereas criminal law is guilty or not-guilty beyond a reasonable doubt, so it is 100% guilty or not guilty. If there is any doubt whatsoever the criminal case will relay a verdict of not guilty. 2. The United States Supreme Court’s primary role is to be a guardian of the Constitution. They have judicial review power which is the power to declare congressional and presidential acts unconstitutional. Certorari power is the authority of the Supreme Court to select a case for review, based on agreement of 4 members that a case may cause significant constitutional or federal issues. 3. Restorative justice is a model of deterrence that uses restitution programs, work programs, and other strategies to rehabilitate the offender and address the damage the offender has done to the community and the victim. An example is when a court orders a defendant that broke into a car to pay restitution to the victim and requires community service to help clean that community.
