MGI Ch 3 The legal environment: equal employment opportunity and safety 9/5/17 US legal system - Legislative - Executive - Judicial Equal Employment Opportunity (EEO) - Governments attempts to ensure all individuals have equal chance for employment regardless of o Race o Color o Age o Religion o Sex/gender o National origin o Mental or physical ability Congressional Legislation - Title VII of the civil rights act of 1964 o Prohibits discrimination in hiring, firing, pay based on race, religion, sex, national origin o If you remember nothing else - Equal pay act of 1963 - Age discrimination in employment act of 1967 - Pregnancy discrimination act - Americans with disabilities act - Uniformed services employment reemployment rights act - Immigration reform and control act o If you do hire, it is illegal to discriminate against Reasonable Accomodation - Make “reasonable accommodation” to physically or mentally disabled person unless would impose “undue hardship” - Religion and accommodation – employee must demonstrate o Legitimate religious beliefs o Notice provided for need of accommodation o Adverse consequence occurred - Disability and accommodation – employer accommodations o Readily accessable facilities o Alternative testing formats, readers, additional time, interpreters or reading assistance technology o Job restructuring o Reassignment
