Introduction According to the case given under the commercial law assignment question,Alan who is a student of Kaplan Higher Education, had posted an offer to sellhis textbook “Introduction to Business Law in Singapore”, together with hishandwritten notes in an exercise book for $200 on his Facebook page on 1 Nov2015. The parties who were interested to make the purchase and involved inthis case were Bernard, Charleen and Damien. Firstly, I would like to ensure ifall the elements have been fulfilled to establish a valid contract between Alanand the offerees. Hence there are four essentials necessary to create a legallybinding contract which are agreement, consideration, intention to enter intolegal relations and capacity to contract (SingaporeLegalAdvice.com, 2012). In thefollowing, i will look into each and individual’s issue and position in this casestudy if the contract is formed and provide suggestions base on legal principlesand procedures.Overview of the Case study : On 2 Nov 2015,Bernard who is a friend of Alan, saw his offer on Facebook and expressed hisinterest in purchasing the material from Alan by replying on Alan’s Facebookwall saying: “I am keen to buy. But can you sell at $150.00?” On the same day,Alan’s sister who is still an ‘O’ level student wanted to buy his textbook for herinterest in Business Law. She asked Alan if she could pass him the money on 6Nov, Alan merely nodded while his mind was being distracted away. On 3 Nov 2015,Damien, friend of Bernard and also a student of Kaplan higher Education heardabout Alan’s offer, contacted him and accepted his offer at the price of $200.

Alan told Bernard that he is only selling his material at $200 and there was anoffer made already. Later, Bernard changed his mind and decided to buy Alan’smaterial at the initial price.On 4 Nov 2015,Bernard mailed the $200 cash in an envelope to Alan in the morning before hewent overseas. In the evening, Damien saw Alan at school campus and passedhim the payment for his Commercial Law material. Alan took the money andpromised to hand over the material to Damien on 7 Nov.
